T/AS Eastern Country Foods General Terms and Conditions of Trading

All business carried out by the company is subject to following terms and conditions of trading. All orders are accepted and goods & services offered subject to these terms and conditions of Trading:

Currency: Payments must be made in pounds sterling. 

Shipping/Carriage: The final price is the price of the goods including delivery to the stated destination. Please contact info@easterncountryfoods.com for exact x-works collection costs as per quantities or final delivered cost. We only offer prices on application. 

Delivery: All goods will be despatched within 3 – 4 weeks from receipt of order. On 1st time orders or larger orders of full container loads, specific time schedules will be submitted 

Payments: We accept payments by company cheques or account subject to credit approval. All overseas transactions are carried out only on Performa basis. All quotes are x-works Wisbech.

Cancellation: Orders once placed cannot be cancelled. 

Damage in Transit: Sometimes unfortunately, things do get damaged in transit. If this happens to your shipment, please advise us within 3 days and we will supply replacement goods as quickly as we can, you may e-mail details to our customer services dept at info@easterncountryfoods.com. However, since we never knowingly despatch damaged goods, we need your help to try to recover our costs from the carrier wherever possible. If you do receive damaged goods, please retain all relevant documentation so that an insurance claim can be made against the carriers insurer. If you receive a damaged pallet, note the fact on the delivery note, even before you open the pallet to examine the contents. If you are unable to open the damaged package in the presence of the carrier, make sure that you sign for it as "Damaged goods; not yet inspected" or similar to warn the carrier that a claim may be forthcoming. Whatever the circumstances, please contact us by e-mail or telephone with as much detail of the damage or loss as you can provide, as soon as possible, so that we can arrange replacement goods and start following up the carriers. Please do NOT return damaged goods, unless and until requested to do so as this may incur additional costs unnecessarily. Claims in absence of sound documentation will not be accepted.

Returns and Refunds: Goods, which are returned under complaint or for any reason etc., should be returned after confirmation from us. In such circumstances we will carry out a traceability investigation to identify the oversight. If the finding supports the claim we will collect the goods and take appropriate action by rectifying and replacing the goods within 45 days. Any claim for goods or services manufactured or offered by us can not exceed the value of our invoice and in any circumstances will be limited only to the value of invoice. 

New Product Development: A service for creation of commercial products or commercialisation of existing recipes at a cost of £2500/product. The lead time for development on average is 2-4 weeks per product subject to confirmation. This is a chargeable service irrespective of the outcome as lot of expense is incurred during the trial process. Upon completion of trial if an order is confirmed by the customer the NPD cost per product will be credited back into the 1st order invoice. No order, no refund irrespective of the outcome of the trial.

Private label: Goods and services are strictly manufactured as per customer’s specification and directions. The company can not be held responsible for labelling oversights, best before end dates or any claims whatsoever made by clients on their labels in products manufactured by us.

Payment & Retention of Title: Under normal circumstances, goods must be paid for prior to despatch, for goods invoiced on account title of the goods will be retained by Eastern Country Foods until such time a full payment for the goods is received. 

Goods Not Available For Shipment: With the best will in the world, some goods may not be in stock at the time you place your order. In the event that we cannot despatch your goods within 3-4 weeks of receipt of your order, we will contact you to advise the actual situation and take instructions from you on how you would prefer us to proceed. Providing an e-mail address makes this much easier for us both. 

Complaints: All complaints are dealt with equally and fairly by our Customer Services Dept who can be contacted by e-mail at info@easterncountryfoods.com. We will respond to all complaints within seven working days and aim to resolve complaints as soon as possible. 

Terms & Conditions: The right to amend Terms and Conditions of Trading from time to time without notice. 

LAW: English law applies and English courts shall have exclusive jurisdiction. 
 

Disclaimer: Limitation of Liability In no event shall Eastern Country Foods have any liability to you (including liability to any person or persons whose claim or claims are based on or derived from a right or rights claimed by you) with respect to any and all claims at any and all times arising from the subject matter of this web site, in contract, tort, strict liability or otherwise. Eastern Country Foods nor its representatives shall in any event be liable to you or to any third parties for lost of profits, revenues, business opportunities or business advantages whatsoever, nor for any direct, indirect, special, consequential indirect or incidental losses, damages or expenses directly or indirectly relating to the use or misuse of this website or with respect to any other linked website.
